DMCA and copyright

Incantory hosts prompts written by its users and prompts imported from open collections, each credited to its author under its license. If something here infringes your copyright, tell us and we will remove it. Authors can also ask for removal of their own work for any reason, without a formal notice, using the removal request form.

Sending a notice

The quickest route is the removal form with “Copyright infringement (DMCA notice)” as the reason. A notice by email or post must include:

  1. Your physical or electronic signature.
  2. The copyrighted work you believe is infringed (or a representative list, if several).
  3. The URL of each page on Incantory with the material you want removed.
  4. Your name, postal address, telephone number and email address.
  5. A statement that you have a good-faith belief the use is not authorised by the copyright owner, its agent or the law.
  6. A statement, under penalty of perjury, that the information is accurate and that you are the owner or authorised to act for the owner.

What happens next

  1. You get an acknowledgement email with a reference number.
  2. A person on our team reviews the request, usually within a few days.
  3. If it is valid, we remove or disable the material and tell the person who published it (for imported prompts, the collection it came from is credited, and the removal is recorded).
  4. We email you the decision.

Counter-notices

If your prompt was removed and you believe that was a mistake or a misidentification, send the designated agent a counter-notice with: your signature; the removed material and where it appeared; a statement under penalty of perjury that you believe it was removed by mistake or misidentification; your name, address and phone number; and your consent to the jurisdiction of the federal court for your address (or, outside the US, any judicial district where Incantory may be found) and to accept service from the person who sent the notice. Unless they tell us they have filed a court action, we restore the material in 10 to 14 business days.

Repeat infringers

Accounts that repeatedly publish infringing material are suspended and, in appropriate cases, closed.
